Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Cholaka (“Cholaka”, “we”, “us”, or “our”) and govern your access to and use of the Cholaka website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Cholaka is an AI-powered social media management platform that lets you connect your social media accounts to schedule and publish content, generate content with AI, manage comments and direct messages, configure automated replies, and view analytics for connected platforms such as Facebook, Instagram, and TikTok.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Connecting third-party platforms

The Service integrates with third-party platforms including Meta (Facebook and Instagram) and TikTok. When you connect an account, you authorize Cholaka to access and act on that account on your behalf through the platform’s official APIs. Your use of each connected platform remains subject to that platform’s own terms and policies, including the TikTok Terms of Service and the TikTok Developer Terms. You represent that you own or have the right to manage every account you connect.

4. Your content

You retain ownership of the content you create, upload, or publish through the Service (“Your Content”). You grant Cholaka a limited license to host, process, and transmit Your Content solely to operate and provide the Service, including publishing it to the platforms you have connected. You are solely responsible for Your Content and for ensuring it complies with applicable law and the rules of each platform.

5. Acceptable use

You agree not to use the Service to:

• violate any law or the terms, policies, or guidelines of a connected platform;
• post spam, misleading, infringing, hateful, or otherwise prohibited content;
• send unsolicited or automated messages in a way that violates a platform’s rules;
• attempt to access, disrupt, or reverse-engineer the Service or its underlying systems; or
• infringe the intellectual property or privacy rights of others.

6. AI-generated content

The Service can generate text and suggestions using artificial intelligence. AI output may be inaccurate or inappropriate. You are responsible for reviewing and editing any AI-generated content before publishing it, and you remain responsible for anything you publish.

7. Subscriptions & payment

Paid plans are billed in advance on a recurring basis according to the plan you select. Fees are non-refundable except where required by law. We may change plan pricing or features with reasonable notice. You can cancel at any time, and your paid access will continue until the end of the current billing period.

8. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or misuse a connected platform. Upon termination, your right to use the Service ends and connected-account tokens are revoked.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will always be compatible with third-party platforms whose APIs may change or become unavailable.

10. Limitation of liability

To the maximum extent permitted by law, Cholaka will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
